Terms of service

These terms apply when a business orders video production from Maqta Films. We work with businesses, not consumers. If we sign a contract or order form with you, that document takes priority over this page. Orders placed through Upwork also follow Upwork's own terms.

1. What we do

We produce short video ads using generative AI tools under human direction. An order is made when you accept our written quote or order form by email, or through an Upwork contract. It states the deliverables, lengths, formats, languages, number of openings, revision rounds, delivery date and price. We deliver finished video files by download link; a test pack is normally delivered in 5 working days.

2. What you give us

You supply the brief and any logos, product images, footage and product claims. You confirm that you hold the rights to these materials, that the claims are true and can be substantiated, and that you hold any licences or permits your product or sector requires.

3. AI and labelling

People direct every ad; generative AI produces the footage. To make your order we process the materials you send with third-party generative AI services. With each delivery we tell you which elements were AI-generated and with which tools, so you can label the ads correctly. Applying platform AI labels when the ads are published is your responsibility.

4. Checks and approval

Before delivery we check each ad against our checklist of UAE and Saudi advertising rules, and Arabic text is proofread by a native speaker. This check is not legal advice. You review and approve every ad and all copy before it is published. Once you approve an ad, responsibility for publishing it and for its compliance in the markets where it runs rests with you. If we hear nothing within 5 business days of delivery, the delivery is treated as approved.

5. Revisions

Each order includes the revision rounds stated in it. A revision is a change within the approved script. A new concept or script is a new order. Extra rounds are charged per ad, at the rate in your order.

6. Fees and payment

Test orders are paid in full before work starts. Projects are 50% before work starts and 50% on delivery, before final files are released. Monthly orders are paid at the start of each month. Prices are in US dollars unless your order says otherwise. Bank charges and any tax your country requires you to withhold are paid by you, so that we receive the invoiced amount. If a payment is more than 7 days late we may pause work until it arrives. Refunds are covered in our refund policy.

7. Rights

When an order is paid in full, we transfer to you all the rights we hold in the final delivered ads. The law on rights in AI-generated material differs between countries and is still developing, so we do not guarantee that it can be registered or that it is protected everywhere. Music and other licensed elements come with their own licences: library music is licensed for online ads, not for television broadcast. Your own materials remain yours.

8. Showing the work

We may show delivered ads in our portfolio unless you ask us not to. Work delivered under an agency's name is never shown without that agency's permission.

9. What we do not make

We do not produce fake customer testimonials, AI-generated people presented as real customers, the likeness of a real person without their documented consent, another company's trademarks without authority, or ads for alcohol, gambling, dating, political or religious content. We may decline any brief we believe would breach advertising rules. We do not buy media or publish ads for you.

10. Confidentiality

Each of us keeps the other's non-public information, briefs and unreleased work confidential and uses it only for the order.

11. Liability

Each party's total liability for an order is limited to the fees paid for that order. Neither party is liable for indirect or consequential loss, lost profit or lost revenue. We do not promise any advertising result. Nothing here excludes liability that the law does not allow to be excluded.

12. Governing law

These terms are governed by the laws of the People's Republic of China, where we are registered, unless your contract or order form states a different governing law. We will always try to settle a disagreement by talking to you first.
